Here is exciting news on discharge upgrades for service personnel claiming PTSD. It would be hard to find anything more user-friendly than a very recent memo from the Secretary of Defense.
The SEDEF’s policy letter speaks of “special consideration” which the boards must give to PTSD-related situations. Several times, the memo uses the word “liberal” to explain its stance..
With this policy letter, [1] There are now presumptions that documented conditions existed at the time of discharge; [2] they will be considered “potential mitigating factors” in weighing misconduct ; [3] the corrections boards will “exercise caution “ in reviewing the cases; and [4] Statute of Limitations matters will be waived in appropriate situations. Also, [5] corrections boards may obtain advisory opinions from mental health professionals within DOD on PTSD-related conditions.
This policy letter should provide a path for many who gained ‘bad’ discharges under situations of traumatic stress.
